The Trump administration has formally announced plans to petition the U.S. Supreme Court to immediately suspend a lower court’s ruling that struck down former President Donald Trump’s global tariff regime, calling the decision a judicial overreach with serious national implications.

On Wednesday, a three-judge panel of the U.S. Court of International Trade ruled that the sweeping tariffs implemented during Trump’s first term exceeded presidential authority, after multiple lawsuits argued the policy created instability in global trade and ignored congressional oversight.

Calling the court’s decision a “clear case of judicial activism,” Trump officials filed for emergency relief on Thursday. The administration warned of irreparable harm to U.S. national security and economic interests if the ruling is allowed to stand without delay.

“This ruling endangers our national trade policy and undermines the president’s constitutional role in safeguarding American industries,” said a senior Trump-era official.

The administration’s legal team confirmed that an appeal will proceed only if the Supreme Court declines to grant a temporary freeze on the lower court’s judgment.

The controversial tariff framework, originally targeting nations like China, Canada, and members of the European Union, was introduced under the guise of protecting domestic manufacturers and leveling trade imbalances. However, critics and foreign governments condemned the strategy as chaotic and retaliatory.
